Cannabis Rules in Vaughan in Plain Words
Vaughan Smoking By-law 074-2019
Vaughan writes cannabis into the same by-law as tobacco and e-cigarettes, so one set of rules covers the whole city. Section 4.0 sets five distances:
- 20 m from wading pools, splash pads, skating rinks, skate parks, sports fields, playgrounds and courts, spectator areas taken in — s. 4.0(7)
- 20 m from a school site or private school named in the Education Act — s. 4.0(8)
- 9 m from a child care centre's public entrance or any window that opens — s. 4.0(9)
- 20 m from a playground under the care and control of a child care centre — s. 4.0(9)
- 20 m around every City-owned community recreational facility, taken from the perimeter — s. 4.0(2)
Before any of those distances apply, the by-law closes the obvious ground: no smoking in an enclosed public place, in any Park, or in or at a City Facility. Recreational cannabis outdoors in public is off the table across Vaughan.
Designated smoking areas are permitted at City facilities and parks, set 9 metres back from entrances under s. 4.0(6). Cannabis is expressly shut out of them, which makes a designated area a tobacco allowance and nothing more.
Two exceptions survive: authorisation to possess cannabis for your own medical purposes, or a court order. Anyone relying on the medical route carries the document and hands it to an officer on demand. The Smoke-Free Ontario Act, 2017 sits above all of it, enforced here by York Region Public Health, and a condo declaration or a lease often goes further still.
