Richmond Hill Cannabis By-law 112-18
By-law 112-18 came into force on 18 October 2018, when Richmond Hill was still a town, and it’s drafted to add to the provincial rules rather than replace them. The city stacks two more documents on top of it, and none of the three deals in metres except at a recreation centre door.
- 9 m from any entrance to a recreation facility, under the city's Smoke-Free Outdoor Spaces policy, in effect since 1 May 2014, which keeps smoking off splash pads, sports fields, playgrounds and sports courts too
- 20 m the provincial setback from school grounds, children's playgrounds, publicly owned sporting areas and community recreational grounds
- 9 m the provincial setback from restaurant and bar patios and from hospital, psychiatric facility and long-term care entrances
Section 3.1 is written as an addition to the Smoke-Free Ontario Act, 2017 rather than a substitute for it: no smoking or vaporizing cannabis, and no holding lighted cannabis, in any Public Place. Richmond Hill’s definition of a public place runs further than most — municipal offices, parks, trails and natural areas, public and private parking lots, arenas, community centres, libraries and pools, every school and child care facility, retail and commercial premises including malls, and roads, sidewalks and municipal boulevards. A motor vehicle counts too when it sits in a public place or anywhere open to public view. Fines run from $100 to $500 on a first conviction and from $500 to $1,000 on a second.
Two further city documents sit alongside the by-law. The Smoke-Free Outdoor Spaces policy, adopted by council and in effect since 1 May 2014, sets the 9-metre rule at recreation facility entrances. Parks By-law 19-22 states plainly that nobody in a park may consume cannabis other than in accordance with the Cannabis By-law. The 20-metre figures come from the province, enforced locally by York Region Public Health, and Ontario’s legal age is 19+.
Privately owned property holding one or more dwellings falls outside the by-law, as does anyone entitled to possess cannabis under a medical document. What happens inside your own walls answers to your lease or condo declaration instead, and those documents routinely reach further than the city does — balconies first.
