Cannabis Rules in Newmarket in Plain Words
Newmarket Smoking By-law 2019-31
Newmarket passed its Smoking By-law on 27 May 2019, and the recitals state the purpose flatly: to prohibit the smoking of tobacco, cannabis and any other non-tobacco products in prescribed places in the town. The distances that matter here are provincial ones, listed below.
- 20 m provincial setback from the perimeter of a public playground or a publicly owned sports field surface, and from school grounds
- 9 m provincial setback from any entrance or exit of a hospital, psychiatric facility or long-term care home — the rule that governs the doors at Southlake on Davis Drive
With limited exceptions the by-law regulates smoking and vaping on public property, which leaves private property owners to set their own terms. On the Town’s side it covers all Town-owned parks, green spaces and trails, any property with a school, daycare or other child care facility on it, and street furniture maintained, owned or leased by the Town, benches and picnic tables included. Smoking is permitted in Designated Smoking Areas and nowhere else on that list. The definition of smoking reaches a lighted cigar, cigarette, pipe, e-cigarette, electronic vaporizer or any other activated equipment holding tobacco, cannabis or another substance, so vaping sits inside the by-law rather than beside it.
The Municipal Act keeps highways out of municipal reach, and a highway takes in the municipal boulevard, which is why sidewalks fall outside the rules — Town staff came to the same conclusion about the laneway between Main and Cedar streets downtown. Sitting above the by-law is the Smoke-Free Ontario Act, 2017, the source of both figures in the panel, enforced locally by York Region Public Health. Ontario fixes the age at 19+.
Section 4.3 exempts a person authorised to possess cannabis for medical purposes under Part 14 of the Cannabis Regulations or by court order, on the condition that the document is carried at all times and surrendered to an Officer on demand. Then comes your own building, the layer with the least consistency and often the most teeth. Leases and condo declarations around the Yonge and Davis towers commonly rule out smoking on balconies and inside the unit.
