Two carve-outs matter at the door: public highways sit outside the by-law’s definition of a Public Place, and a private dwelling stays exempt, with the exception of one in use as a public place, school or child care facility.
Above the town sits the Smoke-Free Ontario Act, 2017, which sets the metre setbacks above and bans smoking and vaping in enclosed public places, enclosed workplaces and a vehicle being driven. York Region Public Health is the local health-side contact. The by-law leans on the Act openly, relying on section 18, under which a stricter municipal rule prevails.
