Toronto Municipal Code Chapters 709, 608 and 636

Mel Lastman Square is the shortest version of Toronto’s smoking rules: step inside the limits of the square at 5100 Yonge Street and there’s no setback to pace out, since the ban is total.

Chapter 636 covers Toronto’s named civic squares, and Mel Lastman Square is one of them — defined by reference to the former City of North York By-law No. 30809 and closed to smoking inside its own boundary. Step out onto the public road and the square’s rule stops, at which point the nine-metre rule takes over.

That nine-metre rule is Chapter 709. It measures from any entrance or exit of a public building, and Toronto’s wording pulls in condominium and apartment buildings that are open to the public, so the front door of a Willowdale tower counts. It applies to lit tobacco and lit cannabis, and vaping falls outside it. Parks work the other way around: Chapter 608 sets 20 metres around sports fields, playground equipment, splash pads, skate parks, outdoor pools, picnic shelters and public washrooms, and that one does take in vaping.

Underneath all of that sits the Smoke-Free Ontario Act, 2017, which Toronto Public Health enforces here: 20 metres from schools and public sporting areas, nine metres from restaurant patios and hospital doors. Legal age is 19, the public carry limit is 30 grams, and cannabis stays out of a vehicle in motion or about to be. Landlords and condo boards add their own terms on top, and a balcony ban is common.
