Markham Cannabis By-law 2018-135

Markham’s Cannabis By-law does one thing and does it broadly: no smoking or vaporizing cannabis in a public place, anywhere in the city. It carries no metre figures of its own, so the distances below are Ontario’s, and they apply on top.

Section 3.1 bars any person from smoking, vaporizing, holding or otherwise using lighted cannabis in a Public Place. The list of public places is long. It takes in municipal arenas, community centres, libraries, parks and pools, schools and daycares, public and private parking lots, and retail, commercial and business premises including shopping malls. Markham was the first municipality in the wider Toronto area to pass a by-law of this kind. The amendment of 24 September 2019 sharpened the wording. ‘Recreational’ came out of the title and a definition of smoking went in. Roads, sidewalks and municipal boulevards came out of the Public Place definition. Shelters and enclosed spaces on a public highway stayed in.

Private property holding one or more dwellings sits outside the by-law entirely. So does anyone entitled to possess cannabis under a medical document. Above the city sits the Smoke-Free Ontario Act, 2017. It supplies every number in the panel above. The same Act keeps smoking and vaping out of enclosed public places, enclosed workplaces and any vehicle being driven. York Region Public Health handles that layer locally and publishes its own guidance on smoke-free and vape-free spaces. Ontario’s legal age is 19+.

Your own building is the last layer and often the strictest one. Condo declarations and rental agreements across Markham routinely prohibit smoking on balconies and inside units. Those terms hold on their own, no matter what the city and the province permit.
