Toronto Municipal Code Chapter 636 (Public Squares), with Chapters 709 and 608
Albert Campbell Square, outside the Civic Centre on Borough Drive, is named in Toronto’s public squares by-law — the one spot around here with a flat no rather than a distance.
- 0 m inside Albert Campbell Square at the Scarborough Civic Centre, where smoking is prohibited within the limits of the square
- 20 m around sports fields, playgrounds, splash pads, skate parks, outdoor pools and picnic shelters in any City park, vaping included
- 9 m from an entrance or exit of a public building, condo and apartment lobbies among them, for lit cannabis and tobacco
- 9 m from restaurant and bar patios and from hospital entrances, under provincial law
Chapter 636 lists Toronto’s civic squares by name, and Albert Campbell Square — defined through the former City of Scarborough By-law No. 24415 — is on that list. Inside the limits of the square there’s no setback to work out, since smoking is prohibited outright. The one exception is the part of the square sitting on a public highway, which falls back to the ordinary street rules.
Those ordinary rules split in two. Chapter 709 keeps lit tobacco and lit cannabis nine metres back from any entrance or exit of a public building, and Toronto’s definition of a public building reaches condominium and apartment buildings open to the public, plus places of employment. Vaping sits outside that one. Chapter 608 is the parks rule at 20 metres — sports fields, playground surfaces and equipment, splash pads and wading pools, skate and BMX parks, outdoor pools and decks, picnic shelters, outdoor theatres and washrooms — and it catches vaping alongside smoking. Swimming beaches, zoo and farm areas and off-leash areas are no-smoking outright, which matters down at Bluffer’s Park.
The provincial floor is the Smoke-Free Ontario Act, 2017, enforced in Scarborough by Toronto Public Health: 20 metres from schools, playgrounds and public sporting areas, nine metres from patios and hospital entrances, legal age 19, 30 grams on you in public. Consumption in a moving vehicle is prohibited across the province. Building rules stack on top of that, and most leases and condo declarations rule out balconies.
