Vaughan By-law 074-2019 west of Yonge, Markham By-law 2018-135 east of it

Thornhill sits in two municipalities and the smoking rules split with the address book at Yonge Street. West of Yonge you’re under Vaughan’s Smoking By-law 074-2019, which sets its own metre setbacks. East of Yonge you’re under Markham’s Cannabis By-law 2018-135, which sets none at all and leaves the numbers to the province.

West of Yonge, By-law 074-2019 regulates tobacco, cannabis, electronic cigarettes and like substances throughout the City of Vaughan. It repealed the older by-laws 84-2012 and 127-2013. Section 4.0 prohibits smoking in an enclosed public place, in a park, and in or at a city facility, then adds the setbacks listed above. Some city facilities and parks have designated smoking areas. Those areas have to sit at least 9 metres from any public entrance or openable window. Cannabis is excluded from them outright.

East of Yonge, Markham’s Cannabis By-law 2018-135 works the other way round: one flat prohibition in place of a list of distances. No person may smoke or vaporize cannabis in any Public Place in Markham. That takes in arenas, community centres, libraries, parks, pools, schools, daycares, parking lots and retail premises including malls. Every metre figure on that side of the street comes from the Smoke-Free Ontario Act, 2017 instead. Private property holding one or more dwellings falls outside both regimes, and Markham’s by-law exempts anyone with a medical document.

In practice the Vaughan half is more specific and the Markham half is broader. The same stretch of Yonge Street can fall either way, depending on which curb you’re standing on. York Region Public Health enforces the provincial layer for both, and Ontario’s legal age is 19+ on both. Your building adds the final layer. Condo declarations and leases near Promenade and along Royal Orchard Boulevard alike ban balcony smoking as a matter of routine.
